Applicant is a victim of kidnapping and attempted SA by strangers in late March 2020. She would like assistance to obtain a U-Visa or assistance with her immigration process.

client has been in a common law marriage for 21 yrs, they both have 2 children of the marriage a 21 yr old and a 12 yr old who stayed with dad. Dometic Violence has happend and reports have been made to the police, she is currently in a Shelter since May 19th after staying in a hotel for several days. She is spanish speaking
Client seeks assistance with divorce from her abusive husband. Client states they are common law married with 5 shared children under 10 years old. Applicant currently does have a restraining order against the adverse party (granted March 2020)
Client states she wants to adjust her status but she is afraid she isn't going to be able to do so. When she applied for her residency she stated she was divorced. Client stated INS flagged her for dishonesty because they found out she was not officially divorced. Client didn't know she wasn't officially divorced because her attorney failed to communicate with her. Client stated she just found out her attorney failed to finalize the divorce. Client doesn't have a criminal record. Client separated with adverse party due to domestic violence.
Client is seeking to adjust her immigration status from TPS to U-Visa. Client and her son were victims of an assault while trying to get money from an ATM. Client was attacked by 3 robbers and shot at 3 times. Police were able to identify and apprehend one of the robbers with the help of the Client. Spanish speaking.

I represent client in immigration removal proceedings. While she was detained proceedings were initiated against her by her abusive ex-husband who is currently in charge of their 2 sons. I do not see any legal custody determination at this point. There is currently a SAPCR pending asking for conservatorship appointed and child support from Ms. Rojas if she is deemed not to be the primary conservator. Ms Rojas has been in immigration detention since last September and was just released on 4/17/20. She has not been able to attend any settings although her abuser has. Ms.
