Applicant would like assistance with an immigration/U-Visa matter. She is a victim of sexual assault (rape) and domestic violence at the hands of the father of her 7 year old child. Client has been in the United States for 26 years. Investigation regarding the DV/SA is pending.
I represent client in immigration removal proceedings. While she was detained proceedings were initiated against her by her abusive ex-husband who is currently in charge of their 2 sons. I do not see any legal custody determination at this point. There is currently a SAPCR pending asking for conservatorship appointed and child support from Ms. Rojas if she is deemed not to be the primary conservator. Ms Rojas has been in immigration detention since last September and was just released on 4/17/20. She has not been able to attend any settings although her abuser has. Ms.
Client wants assistance in obtaining U-VISA due to being victim of a violent crime. The incident occurred November 21st 2019 around 8pm. Client was shot by his brother in law in an attempt to keep him from killing two other people. Client has complied with police in trying to find the adverse party and was interview in January of 2020.Client was in a coma for 2 days, and hospitalized for 10 days total. Client currently has a job that he has worked at for 20 years, but would like a work permit so he can change jobs and earn more money for his family.
Antonia and Javier need assistance with custody paperwork of their 1 year old grandson. 16 year old daughter, Sophia, mother of 1 year old, is wanting to give custody to her parents. Sophia is a trafficking victim in which the FBI investigated and eventually the subject was prosecuted and convicted of trafficking. I'm not sure if the proper wording is conservatorship, custody or guardianship.
client has been separated for several years and wants a divorce, 2 children of the marriage. (English speaking)
client is seeking assistance with a possible U-visa case that was previously denied.
Exoneration: client desires to be exonerated from prostitution charges she obtained during her trafficking experience with the purpose of being rescued by police.
Civil Rights Violation: client was kidnapped, beaten, raped and trafficked.
Negligence by Houston Police Department: HPD was negligent when the client voiced that she had been kidnapped and they took no measures to assist and released her to her trafficker.
Family was a victim of an assault on September 5th and had to go to the hospital, on Sept. 9 they had court to appear due to falling behind on their rent. Due to the assault and the trauma they went thru they forgot, today Oct. 14 they received a 24 hr. eviction notice. They want to know what they can do or what are their rights.
We are assisting client with her immigration status. She is a victim of domestic violence and sexual assault. The last incident occurred in April 2019. The perpetrator is her husband and father of her two minor children. She is seeking representation for a divorce, child custody and child support. She is in the process of applying for a protective order as well.
